Section 89
Document to be evidenced
: In the case of military court proceedings, the following documents will be taken as evidence:-
(a) Particulars mentioned by the concerned person in Citrol form at the time of appointment,
(b) Complete copy of the CITrol form or a copy signed by the officer in charge of the form stating that “the copy is correct in its entirety”,
(c) any letter, post-letter or other document signed by the Commander-in-Chief or an officer designated by him on the authority of the Government of Nepal in relation to serving in the Nepali Army, being dismissed or relieved of duty,
(d) Military orders registered in the book of the Nepalese Army or military orders or published in the Nepal Gazette or the status, rank and appointment of other officers, military orders registered in the same book or mentioned in the Nepal Gazette,
(e) records recorded in the regimental book signed by the commanding officer or the officer responsible for keeping the records,
(f) the transactions mentioned in the copy certified by the signature of the officer in charge of the bookkeeping that the copy is correct in accordance with the law,
(g) If any person within the jurisdiction of this Act who is under trial for an offense under Sections 42 and 58 has surrendered to any officer or any part of the Nepali Army, or if such person has been arrested by any officer or any person within the jurisdiction of this Act, such officer or such person shall The person or the commanding officer of that part of the Nepalese army surrendered or was arrested, the place, date and the actual facts about the dress worn by the person, as stated in the letter certified by signature,
(h) At the time when any person within the jurisdiction of this Act who is under the jurisdiction of this Act surrenders before the head of the police station or when such person is arrested by the head of the police station, the place, date and the dress worn by that police officer.
